Plaintiff-appellant Terry A. Rocha appeals from a jury verdict entered in favor of Great American Insurance Company ("Great American" or "the Company"), the defendant-appellee, in this action for age discrimination. For the following reasons, we find that the court erred in its continuous commentary and interrogation of plaintiffs witnesses, thus depriving Rocha of the fair and impartial trial to which he was entitled. Accordingly, we reverse and remand this action, thereby granting Rochas request that he be given a new trial.
